These SMS Terms of Service (the "SMS Terms") govern your use of the SMS Program (as defined below) of Jiro Health Inc. ("Jiro", "we", "our", or "us"). By providing your mobile phone number and opting in to receive text messages from Jiro, you agree to these SMS Terms, our End User License Agreement, and our Privacy Policy.
1. Program Description
Jiro offers a text messaging (SMS or MMS) program through which we send text messages to users who have opted in to receive communications from us, including for service-related and informational communications or marketing-related communications (collectively, the "SMS Program"). By enrolling in the SMS Program, you consent to receiving recurring automated text messages from Jiro related to the subject matter for which you opted in, which may include:
- Service-related communications, such as:
- Account creation
- Account activity
- Service updates
- Surveys and feedback requests
- Reminders
- Other informational messages related to your Jiro account or the Jiro software platform
- Marketing-related communications, such as:
- Product and feature announcements
- Onboarding and engagement reminders
- Continuing Medical Education (CME) availability and updates
- Perks, sponsored promotions, and special offers
2. Consent to Receive Messages
By opting in (e.g., by checking the consent checkbox and submitting your mobile phone number during signup or thereafter within the Jiro software platform, or texting a designated keyword to our short or long code), you expressly consent to receiving recurring automated text messages from Jiro at the mobile number you provide.
Consent to any portion of the SMS Program is not a condition of purchasing any goods or services from Jiro or of using the Jiro software platform.
3. Message Frequency
Message frequency varies based on your interactions with Jiro, the Jiro software platform, and the portion(s) of the SMS Program in which you are enrolled. You may receive multiple messages per week depending on program activity and the campaigns then in progress.
4. Message and Data Rates
Message and data rates may apply. Your mobile carrier may charge fees for sending or receiving text messages, including SMS and MMS messages. Please contact your mobile carrier for details about your messaging plan and applicable charges. Jiro is not responsible for any carrier charges incurred in connection with your participation in the SMS Program.
5. Opt-Out Instructions
You may opt out of the applicable portion(s) of the SMS Program at any time by replying "STOP" to any message thereunder. After you send "STOP" we will send you a confirmation message, and you will no longer receive text messages from the applicable portion(s) of the SMS Program. You may also opt out by contacting us at support@jirohealth.com.
If you would like to receive text messages from us again, you may re-enroll by following the original opt-in procedure.
6. Help Instructions
For help or additional information regarding the SMS Program, reply "HELP" to any text message you receive from Jiro, or contact us at support@jirohealth.com. You may also visit https://jirohealth.com for more information.
7. Supported Carriers
The SMS Program is generally available on major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.
8. Eligibility
You must be at least 18 years of age and the subscriber or authorized user of the mobile phone number you provide to participate in the SMS Program. By opting in, you represent and warrant that you meet these requirements and that you are providing your own mobile phone number (not someone else's).
9. Privacy
Jiro's collection, use, retention, and disclosure of information in connection with the SMS Program —including your mobile phone number, consent timestamp, opt-in source, and message history— is governed by our Privacy Policy, which is incorporated into these SMS Terms by reference.
10. Changes to the SMS Program and These SMS Terms
Jiro may modify or terminate the SMS Program, or change these SMS Terms, at any time, with or without notice. We will notify you of changes to these SMS Terms by updating the "last updated" date above and posting the updated SMS Terms within the Jiro software platform. Your continued participation in the SMS Program after any such changes constitutes your acceptance of the modified SMS Terms.
11. Disclaimer and Limitation of Liability
The SMS Program is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Jiro disclaims all warranties, express or implied, with respect to the SMS Program, and shall not be liable for any delayed, undelivered, or misdirected messages, or for any damages arising from your participation in the SMS Program. Additional disclaimers and liability limitations are set forth in Jiro's End User License Agreement.

13. Governing Law
These SMS Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising under these SMS Terms shall be resolved in accordance with the dispute resolution provisions of our End User License Agreement.
